General Terms and Conditions for Purchases in the nordblanc.com Online Shop

These General Terms and Conditions apply when you, as a consumer, order in our online shop www.nordblanc.com for delivery in Belgium. Please read the terms carefully before you place your order.

1. Seller

Your seller and contracting party is:
NORD E-COM B.V.
Boven de Wolfskuil 3 A 24
6049 LX Herten
The Netherlands
RSIN: 860938293
VAT identification number: NL860938293B01
Email: info.be@nordblanc.com

The address above is not intended for returns or complaints. We cannot process parcels sent there. How to return a product or submit a complaint is explained in clauses 8 and 9 and on the Returns and Complaints page.

2. Scope of Application

(1) These terms govern the rights and obligations between NORD E-COM B.V. (“we”, “us”) and you as the buyer (“you”) when you purchase products in the online shop.

(2) We sell only to consumers, that is, natural persons who act for purposes that fall outside their trade, business, craft or profession. The products are sold for private use, in quantities that are usual for a household.

(3) If we have concluded a separate agreement with you, it takes precedence over these terms to the extent that it deviates from them.

(4) These terms do not affect your rights under mandatory consumer law, including Book VI (Market Practices and Consumer Protection) of the Code of Economic Law (Wetboek van economisch recht, WER) and the provisions on sales to consumers in the Civil Code (Burgerlijk Wetboek, BW).

3. Language of the Contract and Storage of the Terms

These terms are available in Dutch and French. The contract is concluded in the language in which you place your order. You can consult the terms on our website at any time and save or print them using your browser’s functions. After placing your order, you will receive an order confirmation by email with the details of your order.

4. Placing an Order and Conclusion of the Contract

(1) The products in the online shop do not constitute a binding offer but an invitation to place an order.

(2) You add products to the cart, go to the checkout page, fill in the required information, select the delivery method and the payment method and review your order. Before you submit the order, you can go back at any time, correct your information or abandon the purchase.

(3) When you click the button with which you complete and pay for the order (order with obligation to pay), you make a binding offer to buy and you agree to these terms.

(4) We confirm your order by email. The contract is concluded as soon as you have received the order confirmation.

(5) If an ordered product cannot be delivered, for example because it is no longer in stock, or if the price has been stated manifestly incorrectly, we have the right to cancel the contract for that product. In that case we will inform you without delay and refund the amount you paid for the product.

5. Customer Account

You can create a customer account or order without an account. You are responsible for keeping your login details confidential. We may close an account that has not been used for a long time or that is being misused. You can ask for your account to be deleted at any time.

6. Prices and Payment

(1) All prices are stated in euros (EUR) and include VAT (21%). Any delivery costs are added to this and are shown at checkout before you complete the order. Which delivery methods we offer is explained on the Payment and Shipping page.

(2) If a price changes, the price that was visible when you placed your order applies to your order.

(3) You can pay using the payment methods shown at checkout, such as credit and debit cards, Apple Pay, Google Pay and PayPal. Payments are processed by our payment service providers Shopify Payments and PayPal.

(4) You agree that receipts, invoices and other communications relating to your purchase are sent electronically.

7. Delivery

(1) We deliver only in Belgium.

(2) We offer two delivery methods: delivery to a pick-up point and home delivery. Depending on the delivery method you choose when you place your order, we ship the products to the pick-up point you choose or to the address you provide. The expected delivery time is shown at checkout. Unless another delivery time has been agreed, we deliver without undue delay and no later than 30 days after the contract has been concluded.

(3) If the delivery is delayed, we will inform you of this. Your rights in the event of delayed delivery follow from the law.

(4) The risk of damage to or loss of the products passes to you as soon as you, or a third party designated by you who is not the carrier, have taken physical possession of the products.

(5) If the parcel is visibly damaged or incomplete on delivery, please report this, preferably to the carrier, and contact us as soon as possible. This does not affect your statutory rights.

(6) The products remain our property until they have been paid for in full.

8. Right of Withdrawal and 30-Day Right of Return

(1) Under the law (Article VI.47 et seq. WER) you have the right to withdraw from the contract within 14 calendar days without giving any reason (right of withdrawal). The withdrawal period begins on the day after the products are received by you or by a third party designated by you who is not the carrier. If the order is delivered in several shipments, the period begins on the day after the last part is received.

(2) In addition, we voluntarily extend the period to 30 days after receipt (30-day right of return). The statutory right of withdrawal is 14 days; the additional 16 days are a voluntary extension that goes beyond what the law requires. The same terms as for the right of withdrawal under this clause apply throughout the entire period.

(3) You withdraw from the contract by notifying us of your decision before the period has expired, for example via the returns function in your customer account or on the order status page, by email to info.be@nordblanc.com or using the model withdrawal form at the bottom of these terms. You can withdraw from the contract for the whole order or for part of it. Use of the model form is not mandatory: any other unequivocal statement in which you make your decision known is sufficient. It is sufficient that you send your notice before the period has expired.

(4) You must send the products back without undue delay and in any event within 14 days after you have informed us that you are withdrawing from the contract. The direct cost of returning the products is borne by you. How to return them is explained in the return instructions you receive from us and on the Returns and Complaints page: after you have notified us of your return, we will send you a Packeta return code by email, with which you can hand in the parcel at a Packeta pick-up point. For the use of our return code we charge € 5; we deduct this amount from the amount we refund to you.

(5) We refund everything you paid for the returned products no later than 14 days after we have received your notice of withdrawal. If you withdraw from the whole contract, we also refund the original delivery costs up to the amount of the cheapest standard delivery that we offer, but not the additional costs arising from your choice of a more expensive delivery method. We use the same payment method as you used for the purchase, unless you expressly agree to a different method; no costs are incurred by you as a result. We may withhold the refund until we have received the products back or until you have shown that you have sent them back, whichever is earlier.

(6) You may try out the product as you would be allowed to in a shop, in order to establish its nature, characteristics and functioning and to assess whether it fits. If you handle it more than is necessary for this, you are liable for any diminished value of the product, and we may deduct a corresponding amount from the refund. Therefore try on clothes and shoes carefully, on a clean and dry surface, and leave the labels attached.

(7) The right of withdrawal does not apply to products that have been made to your specifications or are clearly personalised, to sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery, nor in the other cases in which the law excludes the right of withdrawal.

(8) If you received a gift together with the product and you withdraw from the contract, you must also return the gift.

9. Statutory Guarantee and Complaints

(1) Under the law (Article 1649bis et seq. BW) we guarantee that the products conform to the contract. You have the right to a statutory guarantee of two years: we are liable for any lack of conformity that exists at the time of delivery and that becomes apparent within two years after delivery.

(2) A defect that becomes apparent within two years after delivery is presumed to have existed at the time of delivery, unless the contrary is proved or this is incompatible with the nature of the product or of the defect. Throughout this entire period of two years, the burden of proof lies with us as the seller.

(3) You must inform us within two months after you have noticed the defect that the product does not conform to the contract.

(4) If the product does not conform to the contract, you are entitled in the first instance to repair or replacement free of charge. If repair or replacement is impossible, does not take place within a reasonable time and without significant inconvenience to you, or if we refuse it, you are entitled to a proportionate price reduction or to cancel the contract. Cancellation is not possible if the defect is minor. In addition, you may be entitled by law to damages.

(5) The statutory guarantee does not cover normal wear and tear or damage that has arisen after delivery, for example because the care instructions on the label of the product have not been followed (washing at the wrong temperature, tumble drying, dry cleaning or ironing of items that cannot withstand it) or through an accident.

(6) How to make a complaint: send an email to info.be@nordblanc.com with your order number, a brief description of the defect and, ideally, photos. Do not send the product to us before you have received our instructions. If your complaint is justified, we will bear the cost of return shipping and reimburse the reasonable costs you have incurred in connection with the complaint.

(7) We confirm receipt of your complaint and respond as soon as possible, in any event within 30 days. If we do not accept your complaint, we will explain our reasons in writing and inform you of the possibility of contacting the Consumentenombudsdienst (Consumer Mediation Service) (see clause 11).

10. Personal Data

We process your personal data in accordance with the General Data Protection Regulation (GDPR). More information can be found in our Privacy Policy on the Privacy and Cookie Policy page.

11. Dispute Resolution

If you are not satisfied, we would first of all like to resolve the matter together with you. Please contact us at info.be@nordblanc.com. If we cannot reach an agreement, you can contact the Consumentenombudsdienst, www.consumentenombudsdienst.be, for an out-of-court resolution of the dispute. The Europees Consumentencentrum België (European Consumer Centre Belgium), www.eccbelgie.be, provides advice and assistance in disputes with businesses from other EU countries. You can also bring your dispute before the competent court.

12. Governing Law

Belgian law applies to the contract. This choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you habitually reside.

13. Changes to the Terms

We may change these terms. The terms that applied at the time you placed your order apply to your order.
