These terms and conditions of sale apply when you, as a consumer, make a purchase from our online shop www.nordblanc.com. Please read the terms through before you place your order.

The seller and your contracting party is:
NORD E-COM B.V.

6049 LX Herten
The Netherlands
RSIN: 860938293
VAT registration number: NL860938293B01

The address above is not intended for returns or complaints. Parcels sent there cannot be processed. How to return goods or make a complaint is described in clauses 8 and 9 and on the Returns and Complaints page.

2. Scope of Application

(1) These terms govern the rights and obligations between NORD E-COM B.V. (“we”) and you as the buyer (“you”) when you purchase goods from the online shop.

(2) We sell only to consumers, that is, natural persons who make a purchase for a purpose that is not mainly related to their economic or professional activity. The goods are sold for personal use and in quantities customary in a household.

(3) If we have entered into a separate agreement with you, it applies instead of these terms to the extent that it deviates from them.

(4) These terms do not limit your rights arising from mandatory consumer protection rules, in particular the Law of Obligations Act (võlaõigusseadus) and the Consumer Protection Act (tarbijakaitseseadus).

3. Contract Language and Storage of the Terms

The contract is concluded in Estonian. You can read the terms on our website at any time and save or print them using your browser’s functions. After placing your order, you will receive an order confirmation by email with the details of your order.

4. Placing an Order and Conclusion of the Contract

(1) The products presented in the online shop are not a binding offer but an invitation to place orders.

(2) You add goods to the cart, go to the checkout, fill in the required information, select the delivery and payment methods and review the order. Before you submit the order, you can go back at any time, correct your information or abandon the purchase.

(3) When you click the button by which you complete the order and pay for it (the order obliges you to pay), you make a binding offer to purchase and accept these terms.

(4) We confirm your order by email. The contract is concluded at the moment when you have received the order confirmation.

(5) If the ordered goods cannot be delivered, for example because they are out of stock, or if the price has been stated manifestly incorrectly, we have the right to withdraw from the contract with respect to those goods. In that case we will inform you of this without delay and refund the amount paid for the goods.

5. Customer Account

You can create a customer account or shop without an account. You are responsible for keeping your login details confidential. We may close an account that has not been used for a long time or that is being misused. You can request at any time that your account be deleted.

6. Prices and Payment

(1) All prices are stated in euros (EUR) and include VAT (24%). The shipping cost is added to the price of the goods and is shown at checkout, together with the estimated delivery time, before you complete the order. The delivery methods are described on the Payment and Shipping page.

(2) If a price changes, the price that was visible at the time you placed your order applies to your order.

(3) You can pay using the payment methods shown at checkout, for example by debit and credit card or through the payment services Apple Pay, Google Pay and PayPal. Payments are processed by our payment service providers Shopify Payments and PayPal.

(4) You agree that receipts, invoices and other correspondence relating to your purchase are sent to you electronically.

7. Delivery

(1) We deliver only to Estonia.

(2) We send the goods according to the delivery method you have chosen, either to the parcel locker (DPD) selected in the order or by courier to the address given in the order. The estimated delivery time is shown at checkout. Unless otherwise agreed, we deliver the goods without delay and at the latest within 30 days after the contract is concluded.

(3) If the delivery is delayed, we will inform you. Your rights in the event of delayed delivery follow from the Law of Obligations Act.

(4) The risk of accidental destruction or damage of the goods passes to you when you, or a third party designated by you who is not the carrier, have received the goods.

(5) If the parcel is visibly damaged or incomplete on delivery, please ideally notify the carrier of this and contact us as soon as possible. This does not affect your statutory rights.

(6) The goods remain our property until they have been paid for in full.

8. Right of Withdrawal and Return of Goods within 30 Days

(1) Under the Law of Obligations Act, you have the right to withdraw from a distance contract within 14 days without giving any reason. The period starts on the day on which you, or a third party designated by you who is not the carrier, received the goods (statutory right of withdrawal). If the order is delivered in several parts, the period is counted from the day on which you received the last part.

(2) In addition, we voluntarily extend this period to 30 days from receipt of the goods (“30-day right of return”). The statutory right of withdrawal applies for 14 days; the following 16 days are our voluntary extension, which exceeds the requirements of the law. Throughout this entire period the same terms apply as for the statutory right of withdrawal, as described in this clause.

(3) You withdraw from the contract by notifying us of your decision before the period has expired, for example through the returns function in your customer account or on the order status page, by email to info.ee@nordblanc.com or by using the model withdrawal form at the end of these terms. You may withdraw from the entire order or only from some of the goods. Use of the model form is not mandatory. It is sufficient that you send the notice before the period has expired.

(4) You must send the goods back to us without delay and no later than 14 days after you have notified us of your withdrawal. To meet the time limit, it is sufficient that you send the goods back before the period has expired. You bear the direct cost of returning the goods. How to return the goods is described in the return instructions that you receive from us after submitting the withdrawal notice and on the Returns and Complaints page: we will send you a return code by email, with which you can hand the parcel in at a Packeta pick-up point. If you use our return code, we charge a fee of 5 €, which is deducted from the amount to be refunded.

(5) We will refund to you the amount paid for the returned goods without delay and no later than 14 days from the day on which we received your withdrawal notice. If you withdraw from the entire order, we will also refund the original shipping cost up to the amount of the cheapest standard delivery method that we offer, but not any additional cost arising from your choice of a more expensive delivery method. We will refund the money using the same payment method that you used for the purchase, unless otherwise agreed. We may withhold the refund until we have received the goods back or until you have shown that you have sent them back, whichever occurs earlier.

(6) You may inspect the goods in the same way as in a shop in order to assess their nature, characteristics and suitability. If you have handled the goods more than is necessary to establish their nature, characteristics and functioning, you are liable for any diminished value of the goods, and we may make a corresponding deduction from the amount to be refunded. Therefore try on clothes and shoes carefully, on a clean and dry surface, and leave the labels attached.

(7) The right of withdrawal does not apply to goods that have been made according to your instructions or are clearly personalised, to goods in sealed packaging that cannot be returned for health protection or hygiene reasons if the packaging has been opened after delivery, or in the other cases provided for in the Law of Obligations Act.

(8) If you received a gift together with the goods and you withdraw from the contract, also send the gift back.

9. Complaints

(1) You have the right to make a complaint under the Law of Obligations Act. We are liable for a defect (non-conformity of the goods with the terms of the contract) that the goods had at the time of their delivery and that becomes apparent within two years of the delivery of the goods.

(2) If a defect becomes apparent within 12 months after the delivery of the goods, it is presumed that it existed in the goods already at the time of delivery, unless the contrary is proved or this is incompatible with the nature of the goods or of the defect.

(3) You must notify us of the defect within two months after discovering it.

(4) If the goods are defective, you are entitled in the first instance to demand that they be repaired or replaced with new goods. If this is not possible or does not take place within a reasonable time, you are entitled to demand a price reduction or to withdraw from the contract. You may also be entitled to claim damages under the Law of Obligations Act. After the goods have been repaired or replaced, the liability period begins anew.

(5) Our liability does not cover normal wear and tear or damage that has arisen after the delivery of the goods, for example because the care instructions on the label of the goods have not been followed (washing at the wrong temperature, tumble drying, dry cleaning or ironing of goods that cannot withstand it), or as a result of an accident.

(6) To make a complaint, send an email to info.ee@nordblanc.com, stating the order number, a brief description of the defect and, where possible, photos. Do not send the goods to us before you have received our instructions. If the complaint is justified, we will bear the cost of sending the goods back to us and reimburse your reasonable costs connected with the complaint.

(7) We confirm receipt of the complaint and respond to it within 15 days of the complaint being made. If we do not accept the complaint, we will give reasons for our decision in writing and inform you of the possibility of contacting the Consumer Disputes Committee (Tarbijavaidluste komisjon).

10. Personal Data

We process your personal data in accordance with the General Data Protection Regulation (GDPR). More information can be found in our Privacy Policy on the Privacy and Cookie Policy page.

11. Dispute Resolution

If you are not satisfied, we would first and foremost like to resolve the matter together with you. Please contact us at info.ee@nordblanc.com. If we cannot reach an agreement, you can contact the Consumer Disputes Committee (Tarbijavaidluste komisjon) operating at the Consumer Protection and Technical Regulatory Authority (Tarbijakaitse ja Tehnilise Järelevalve Amet, TTJA), www.ttja.ee. The Consumer Disputes Committee is an out-of-court dispute resolution body. In disputes with a business established in another EU Member State (our company is established in the Netherlands), advice and assistance are provided by the European Consumer Centre (Euroopa Liidu tarbija nõustamiskeskus). You can also bring the matter before a court.

12. Governing Law

Estonian law applies to the contract. The choice of Estonian law does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country of your permanent residence.

13. Changes to the Terms

We may change these terms. The terms that were published at the time you placed your order apply to your order.
