2. Scope of Application
(1) These terms govern the mutual rights and obligations of NORD E-COM B.V. (“we”) and you as the buyer (“you”) when you purchase goods in the online shop.
(2) We sell goods only to consumers, that is, natural persons who purchase goods mainly for a purpose that is not related to their business or professional activity. The goods are sold for personal household use in usual quantities.
(3) If we have concluded a separate agreement with you, it takes precedence over these terms to the extent that it differs from them.
(4) These terms do not limit your rights under mandatory consumer protection legislation, including the Consumer Rights Protection Law (Patērētāju tiesību aizsardzības likums) and Cabinet of Ministers Regulation No. 255 of 20 May 2014, “Regulations on Distance Contracts” (Ministru kabineta 2014. gada 20. maija noteikumi Nr. 255 „Noteikumi par distances līgumu”).
3. Contract Language and Storage of the Terms
The contract is concluded in Latvian. You can read these terms on our website at any time, and you can also save or print them using your browser’s functions. After placing your order, you will receive an order confirmation from us by email with information about your order.
4. Placing an Order and Conclusion of the Contract
(1) The goods offered in the online shop are not a binding offer but an invitation to submit an order.
(2) You add goods to the cart, go to the checkout, fill in the required details, select the delivery method and the payment method and review the order. Before you submit the order, you can go back at any time, correct your details or cancel the purchase.
(3) By pressing the button with which you complete the order and make the payment, you submit a binding offer to purchase the goods and agree to these terms.
(4) We confirm your order by email. The contract is concluded at the moment you receive the order confirmation.
(5) If the ordered item cannot be delivered, for example because it is sold out, or if the price is clearly stated incorrectly, we have the right to cancel the contract in respect of that item. In that case we will inform you without delay and refund the amount paid for that item.
5. Customer Account
You can create a customer account or shop without an account. You are responsible for keeping your login details confidential. We may close an account that has not been used for a long time or that is being misused. You can request the deletion of your account at any time.
6. Prices and Payment
(1) All prices are stated in euros (EUR) and include value added tax (VAT 21%). If delivery is not free of charge, the delivery costs are added to the price of the goods and are shown at checkout before the order is completed. For information about delivery methods, see the Payment and Shipping page.
(2) If a price changes, the price that was shown at the time you placed your order applies to your order.
(3) You can pay using the payment methods shown at checkout, for example by debit card or credit card, Apple Pay, Google Pay and PayPal. Payments are processed by our payment service providers Shopify Payments and PayPal.
(4) You agree that receipts, invoices and other communications relating to your purchase are sent electronically.
7. Delivery
(1) We deliver goods only in Latvia.
(2) Depending on the delivery method selected, we send the goods to the parcel locker that you selected in your order (delivery to a parcel locker, DPD) or to the address given in your order (delivery by courier, DPD). The estimated delivery time is shown at checkout. Unless another delivery period has been agreed, we deliver the goods without undue delay and no later than 30 days after the conclusion of the contract.
(3) If delivery is delayed, we will inform you. Your rights in the event of delayed delivery are set out in the legislation in force.
(4) The risk of loss of or damage to the goods passes to you at the moment the goods come into the physical possession of you or of a third party designated by you, other than the carrier.
(5) If the parcel is visibly damaged or incomplete on delivery, please report it to the carrier and contact us as soon as possible. This does not affect your statutory rights.
(6) The goods remain our property until they have been paid for in full.
8. Right of Withdrawal and Returns Within 30 Days
(1) Under the Consumer Rights Protection Law and Cabinet of Ministers Regulation No. 255 of 20 May 2014, “Regulations on Distance Contracts”, you have the right to withdraw from the contract, without giving any reason, within 14 days from the day on which the goods come into the physical possession of you or of a third party designated by you, other than the carrier (statutory right of withdrawal). If the order is delivered in several parts, the period runs from the day on which the last part is received.
(2) In addition, we voluntarily extend this period to 30 days from the day on which you receive the goods (“returns within 30 days”). The statutory right of withdrawal applies for 14 days; the remaining 16 days are our voluntary extension, which goes beyond the requirements of the law. The same terms as for the statutory right of withdrawal described in this clause apply throughout this entire period.
(3) To withdraw from the contract, you must clearly notify us of your decision before the period expires, for example by using the returns function in your customer account or on the order status page, by sending an email to info.lv@nordblanc.com or by using the model withdrawal form at the end of these terms. Use of the form is not mandatory. You may withdraw from the entire contract or only from individual items. The time limit is met if you send the notice before the period expires.
(4) You must send the goods back to us without undue delay and no later than 14 days from the day on which you notified us of your withdrawal from the contract. The time limit is met if you send the goods back before it expires. You bear the direct cost of returning the goods. How to return the goods is described in the return instructions that you will receive from us and on the Returns and Complaints page: after you notify us of the return, we will send you a return code by email, with which you can hand the parcel in at a Packeta point. We charge a fee of 5 € for the use of our return code, which we deduct from the amount to be refunded.
(5) We refund to you all payments made for the returned goods without undue delay and no later than 14 days from the day on which we received your notice of withdrawal from the contract. If you withdraw from the entire contract, we also refund the original delivery costs for the cheapest standard delivery method that we offer, but not the additional costs arising if you have chosen a different, more expensive delivery method. We make the refund using the same payment method that you used for the purchase, unless you expressly agree to a different refund method, for which you will not have to pay. We may postpone the refund until we have received the goods back or you have provided proof that the goods have been sent, whichever is earlier.
(6) You may inspect the goods in the same way as you could in a shop in order to establish their nature, characteristics and fit. If you have used the goods more than is necessary to establish their nature, characteristics and functioning, you are liable for the diminished value of the goods, and we may deduct the corresponding amount from the amount to be refunded. Therefore please try on clothes and shoes carefully, on a clean and dry surface, and leave the tags attached to the goods.
(7) The right of withdrawal does not apply to goods made to your specifications or clearly personalised, to sealed goods that are not suitable for return for health or hygiene reasons if the packaging has been opened after delivery, or in the other cases provided for in the Consumer Rights Protection Law and in Cabinet of Ministers Regulation No. 255.
(8) If you have received a gift together with the goods and you withdraw from the contract, you must also send the gift back.
9. Complaints
(1) You have the right to make a complaint under the Consumer Rights Protection Law. We are liable for any lack of conformity of the goods with the contract that existed at the time of delivery of the goods and becomes apparent within 2 years of the day of delivery of the goods.
(2) If a lack of conformity of the goods with the contract becomes apparent within 12 months of the day of delivery of the goods, it is presumed to have existed at the time of delivery of the goods, unless the contrary is proved or unless this is incompatible with the nature of the goods or of the lack of conformity.
(3) You must notify us of the lack of conformity within 2 months of the day on which you discovered it.
(4) If the goods do not conform with the contract, you are first entitled to request that they be repaired free of charge or replaced with new goods. If this is not possible, if it would involve disproportionate costs or if it is not carried out within a reasonable time, you are entitled to request a price reduction or to cancel the contract. You cannot cancel the contract if the lack of conformity is minor. You may also be entitled to damages under the applicable legislation.
(5) Liability does not cover normal wear and tear, nor damage that has arisen after delivery, for example where the care instructions on the label of the goods have not been followed (washing at the wrong temperature, tumble drying, dry cleaning or ironing of goods that cannot withstand it), or damage caused by an accident.
(6) How to make a complaint: send an email to info.lv@nordblanc.com stating the order number, a brief description of the lack of conformity and, if possible, photos. Do not send the goods to us before you have received our instructions. If the complaint is justified, we will bear the cost of sending the goods back and reimburse your reasonable expenses connected with the complaint.
(7) We confirm receipt of the complaint and respond to it in writing within 15 working days of the day on which the complaint was submitted. If we reject the complaint in whole or in part, we explain our reasons in writing and inform you in writing of the possibility of seeking out-of-court dispute resolution – before the Consumer Disputes Resolution Commission (Patērētāju strīdu risināšanas komisija) of the Consumer Rights Protection Centre (Patērētāju tiesību aizsardzības centrs, PTAC).
10. Personal Data
We process your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation, GDPR). More information can be found in our Privacy Policy on the Privacy and Cookie Policy page.
11. Dispute Resolution
If you are not satisfied, we would first like to resolve the matter together with you. Please contact us by email at info.lv@nordblanc.com. If we cannot reach an agreement, you can contact the Consumer Disputes Resolution Commission of the Consumer Rights Protection Centre (PTAC), which is an out-of-court dispute resolution body, www.ptac.gov.lv. In disputes with businesses from other EU Member States (our company is located in the Netherlands), advice and assistance are provided by the European Consumer Centre in Latvia (Eiropas Patērētāju informēšanas centrs Latvijā, www.ptac.gov.lv). You can also bring the matter before a court.
12. Governing Law
Latvian law applies to the contract. The choice of law does not deprive you of the protection afforded to you by the provisions of the law of the country of your habitual residence from which it is not possible to derogate by agreement.
13. Changes to the Terms
We may change these terms. The terms that were published at the time you placed your order apply to your order.
