NORD E-COM B.V.

The Netherlands
RSIN: 860938293
VAT identification number: NL860938293B01

The address above is not intended for returns or complaints. We cannot process parcels sent there. You can find out how to return a product or make a complaint in clauses 8 and 9 and on the Returns and Complaints page.
2. Scope of Application
(1) These terms govern the rights and obligations between NORD E-COM B.V. (“we”, “us”) and you as the buyer (“you”) when purchasing products in the online shop.
(2) We sell only to consumers, that is, natural persons who are not acting in the course of a profession or business. The products are sold for private use, in quantities that are normal for a household.
(3) If we have concluded a separate agreement with you, it takes precedence over these terms to the extent that it deviates from them.
(4) These terms do not affect your rights under mandatory consumer law, including the rules on consumer sales and distance contracts in Book 6 and Book 7 of the Dutch Civil Code (Burgerlijk Wetboek, BW).
3. Contract Language and Storage of the Terms
The contract is concluded in Dutch. You can consult the terms on our website at any time and save or print them using your browser’s functions. After placing your order, you will receive an order confirmation by email with the details of your order.
4. Placing an Order and Formation of the Contract
(1) The products in the online shop do not constitute a binding offer, but an invitation to place an order.
(2) You add products to the cart, go to the checkout page, fill in the required information, choose the delivery method and the payment method and review your order. Before you submit the order, you can go back at any time, correct your information or abandon the purchase.
(3) When you click the button that completes your order (order with obligation to pay), you make a binding offer to buy and you agree to these terms.
(4) We confirm your order by email. The contract is formed as soon as you have received the order confirmation.
(5) If an ordered product cannot be delivered, for example because it is no longer in stock, or if the price has been stated manifestly incorrectly, we have the right to cancel the contract for that product. In that case we will inform you without delay and refund the amount you paid for the product.
5. Customer Account
You can create a customer account or order without an account. You are responsible for keeping your login details confidential. We may close an account that has not been used for a long time or that is being misused. You can ask for your account to be deleted at any time.
6. Prices and Payment
(1) All prices are stated in euros (EUR) and include VAT (21%). Any shipping costs are added to this and are shown at checkout before you complete the order. You can find the delivery methods we offer on the Payment and Shipping page.
(2) If a price changes, the price that was shown at the time you placed your order applies to your order.
(3) You can pay using the payment methods shown at checkout, such as credit and debit cards, Apple Pay, Google Pay and PayPal. Payments are processed by our payment service providers Shopify Payments and PayPal.
(4) You agree that receipts, invoices and other communications about your purchase are sent electronically.
7. Delivery
(1) We deliver only in the Netherlands.
(2) Depending on the delivery method chosen, we ship the products to the pick-up point you choose with your order or to the address you specify with your order. The expected delivery time is shown at checkout. Unless a different delivery time has been agreed, we deliver without undue delay and no later than 30 days after the contract was concluded.
(3) If delivery is delayed, we will inform you. Your rights in the event of delayed delivery follow from the law.
(4) The risk of damage to or loss of the products passes to you as soon as the products have been received by you or by a third party designated by you, other than the carrier.
(5) If the parcel is visibly damaged or incomplete on delivery, please report this, preferably to the carrier, and contact us as soon as possible. This does not affect your statutory rights.
(6) The products remain our property until they have been paid for in full.
8. Right of Withdrawal and 30-Day Right of Return
(1) Under the law (Article 6:230o et seq. BW), you have the right to withdraw from the contract within 14 days without giving any reason (right of withdrawal, also known as the cooling-off period). The 14-day cooling-off period starts on the day after the products have been received by you or by a third party designated by you, other than the carrier. If the order is delivered in several deliveries, the period starts on the day after the last part has been received.
(2) In addition, we voluntarily extend the period to 30 days after receipt (30-day right of return). The statutory right of withdrawal is 14 days; the extra 16 days are a voluntary extension that goes beyond what the law requires. The same conditions as for the right of withdrawal under this clause apply throughout the entire period.
(3) You withdraw from the contract by notifying us of your decision before the period has expired, for example via the returns function in your customer account or on the order status page, by email to info.nl@nordblanc.com or using the model withdrawal form at the bottom of these terms. You can withdraw from the contract for the whole order or for part of it. Using the model form is not mandatory. It is sufficient that you send your notice before the period has expired.
(4) You must send the products back without undue delay and in any event within 14 days after you have notified us that you are withdrawing from the contract. You bear the direct cost of returning them. You can find out how to return the products in the return instructions you receive from us and on the Returns and Complaints page: after you have registered your return, we will send you a return code by email with which you can hand in the parcel at a Packeta pick-up point. We charge € 5 for the use of our return code; we deduct this amount from the amount we refund to you.
(5) We refund everything you paid for the returned products no later than 14 days after we received your notice of withdrawal. If you withdraw from the whole contract, we also refund the original shipping costs up to the amount of the cheapest standard delivery that we offer, but not the additional costs arising from your choice of a more expensive delivery method. We use the same payment method as you used for the purchase, unless you expressly agree to a different method; no costs are associated with this for you. We may withhold the refund until we have received the products back or until you have shown that you have sent them back, whichever is the earlier.
(6) You may try out the product as you would be allowed to in a shop, in order to establish its nature, characteristics and functioning and to assess whether it fits. If you go further than is necessary for this, you are liable for any diminished value of the product and we may deduct a corresponding amount from the refund. Therefore try on clothes and shoes carefully, on a clean and dry surface, and leave the labels attached.
(7) The right of withdrawal does not apply to products made to your specifications or that are clearly personalised, to sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery, or in the other cases in which the law excludes the right of withdrawal.
(8) If you received a gift together with the product and you withdraw from the contract, you must also return the gift.
9. Complaints and Conformity
(1) We are responsible for ensuring that the products conform to the contract (conformity, Article 7:17 et seq. BW). In the Netherlands there is no fixed statutory warranty period: what matters is how long you may reasonably expect the product to function properly, having regard to, among other things, the price, the quality and the intended use of the product (the expected lifespan). The fact that a certain period has passed since delivery, for example two years, therefore does not automatically rule out a complaint.
(2) A lack of conformity that appears within twelve months of delivery is presumed to have existed at the time of delivery, unless the contrary is proved or this is incompatible with the nature of the product or of the defect.
(3) After you have discovered the defect or should reasonably have discovered it, you must notify us within a reasonable time that the product does not conform to the contract. A notification within two months after you discovered the defect is in any event in due time (Article 7:23 BW).
(4) If the product does not conform to the contract, you are in the first place entitled to free repair or replacement. If repair or replacement is impossible, does not take place within a reasonable time, causes you considerable inconvenience, or we refuse it, you are entitled to a price reduction or to cancellation of the contract. Cancellation is not possible if the defect is of minor significance. In addition, you may be entitled to damages under the law.
(5) Our liability for conformity does not cover normal wear and tear or damage that has arisen after delivery, for example because the care instructions on the product label have not been followed (washing at the wrong temperature, tumble drying, dry cleaning or ironing of products that cannot withstand it) or through an accident.
(6) How to make a complaint: send an email to info.nl@nordblanc.com with your order number, a brief description of the defect and, ideally, photos. Do not send the product to us before you have received our instructions. If your complaint is justified, we will pay the cost of return shipping and reimburse the reasonable costs you incurred in connection with the complaint.
(7) We confirm receipt of your complaint and respond as soon as possible, in any event within 30 days. If we do not accept your complaint, we will explain our reasons in writing and point out to you the options for obtaining help in resolving the dispute (see clause 11).
10. Personal Data
We process your personal data in accordance with the General Data Protection Regulation (GDPR). More information can be found in our Privacy Policy on the Privacy and Cookie Policy page.
11. Disputes
If you are not satisfied, we would first and foremost like to resolve the matter together with you. Please contact us at info.nl@nordblanc.com. If we cannot reach an agreement, you can turn to ConsuWijzer, the information point of the Autoriteit Consument & Markt (ACM, the Netherlands Authority for Consumers and Markets), www.consuwijzer.nl, for information and advice, and to the Juridisch Loket (Legal Aid Desk), www.juridischloket.nl, for legal advice. The Europees Consumenten Centrum (ECC) Nederland (European Consumer Centre Netherlands) provides advice and assistance in disputes with businesses from other EU countries. You can also bring your dispute before the competent court.
12. Governing Law
Dutch law applies to the contract.
13. Changes to the Terms
We may change these terms. The terms that applied at the time you placed your order apply to your order.
