The address above is not intended for sending back returns or goods that are the subject of a complaint. We cannot accept parcels sent to this address. How to return goods and how to make a complaint are explained in clauses 8 and 9 of these Terms and Conditions and on the Returns and Complaints page.
2. Scope of Application
(1) These Terms and Conditions set out the rights and obligations between NORD E-COM B.V. (“we”, “us”) and you as the buyer (“you”) when you purchase goods in the online shop.
(2) We sell only to consumers, that is, natural persons who make a purchase for a purpose not directly related to their business or professional activity (art. 22¹ of the Polish Civil Code, Kodeks cywilny). The goods are sold for private use, in quantities typical for a household.
(3) If we have concluded a separate agreement with you, it takes precedence over these Terms and Conditions to the extent that it deviates from them.
(4) These Terms and Conditions do not limit your rights under mandatory consumer protection provisions, in particular the Polish Consumer Rights Act of 30 May 2014 (ustawa o prawach konsumenta) and the Civil Code.
3. Contract Language and Access to the Terms and Conditions
The contract is concluded in Polish. The Terms and Conditions are available free of charge on our website at any time, and you can save or print them using your browser’s functions. After placing your order, you will receive an order confirmation email from us containing the details of your order.
4. Placing an Order and Conclusion of the Contract
(1) The products presented in the online shop do not constitute a binding offer but an invitation to place orders.
(2) You add goods to the cart, go to the checkout, provide the required information, select the delivery method and the payment method, and review the order. Before you submit the order, you can go back at any time, correct your information or cancel the purchase.
(3) By clicking the button with which you complete and pay for the order (an order with an obligation to pay), you make a binding offer to purchase and accept these Terms and Conditions.
(4) We confirm your order by email. The sales contract is concluded when you receive the order confirmation.
(5) If an ordered item cannot be delivered, for example because it is out of stock, or if the price has been stated manifestly incorrectly, we may cancel the contract in respect of that item. We will inform you of this without delay and refund all payments made for that item.
5. Customer Account and Services Provided by Electronic Means
(1) You can create a customer account or shop without creating an account. You are responsible for keeping your login details confidential. We may close an account that has not been used for a long time or that is being used in a way that is unlawful or contrary to these Terms and Conditions. You can request at any time that your account be deleted.
(2) The customer account and the ability to place orders on the website are services provided by electronic means. The contract for maintaining a customer account is concluded free of charge, for an indefinite period, when the account is created. You can terminate it at any time without giving a reason by requesting that the account be deleted, by email to info.pl@nordblanc.com.
(3) To use these services you need: a device with internet access, an up-to-date web browser with the cookies that are necessary for the operation of the shop enabled, and an active email address. It is prohibited for you to provide content of an unlawful nature.
(4) You can submit complaints regarding the operation of the website or the customer account by email to info.pl@nordblanc.com, describing the problem. We handle them without undue delay and usually respond within 14 days.
6. Prices and Payment
(1) All prices are stated in Polish zloty (PLN) and include VAT (23%). The shipping cost is added to the price of the goods and shown at checkout before you complete the order. Information on shipping methods can be found on the Payment and Shipping page.
(2) If a price changes, the price shown at the time you place your order applies to your order.
(3) You can pay using one of the payment methods shown at checkout, for example a debit or credit card, Apple Pay, Google Pay or PayPal. Payments are handled by our payment service providers: Shopify Payments and PayPal. Payment is made at the time of placing the order.
(4) You agree that confirmations, invoices and other correspondence relating to your purchase are sent electronically.
7. Delivery
(1) We deliver goods only within Poland.
(2) We ship the goods via InPost (delivery to a parcel locker) or DPD (courier delivery), depending on the delivery method selected, to a parcel locker or to the address specified in the order. The estimated delivery time is shown at checkout. Unless another time has been agreed, we deliver the goods without undue delay, no later than 30 days after the conclusion of the contract (art. 543¹ of the Civil Code).
(3) If the delivery is delayed, we will inform you. Your rights in the event of delayed delivery follow from the provisions of the Civil Code.
(4) The risk of accidental loss of or damage to the goods passes to you when you, or a third party designated by you other than the carrier, take possession of the goods (art. 548 § 3 of the Civil Code).
(5) If the parcel is visibly damaged or incomplete on delivery, please report this to the carrier and contact us as soon as possible. This does not affect your statutory rights.
(6) The goods remain our property until they have been paid for in full.
8. Withdrawal from the Contract and 30 Days to Return
(1) Under the Consumer Rights Act, you have the right to withdraw from a distance contract without giving any reason within 14 days from the day on which you, or a third party designated by you other than the carrier, took possession of the goods (art. 27 of the Act; statutory right of withdrawal). If the order is delivered in several parts or batches, the period runs from the day on which the last part or batch was taken into possession.
(2) In addition, we voluntarily extend this period to 30 days from the day on which you took possession of the goods (“30 days to return”). The statutory right of withdrawal applies to you for 14 days; the further 16 days are our voluntary extension, which goes beyond the requirements of the Act. The same rules as for the statutory right of withdrawal, as described in this clause, apply throughout this entire period.
(3) You withdraw from the contract by submitting a statement of withdrawal to us before the period expires, for example using the returns function in your customer account or on the order status page, by email to info.pl@nordblanc.com or on the model withdrawal form set out at the end of these Terms and Conditions (Annex 2 to the Consumer Rights Act). Use of the form is voluntary. You may withdraw from the contract in whole or in respect of selected goods. To meet the deadline, it is sufficient to send the statement before the period expires.
(4) You must return the goods without undue delay, no later than 14 days from the day on which you informed us of your withdrawal from the contract. To meet the deadline, it is sufficient to send the goods back before it expires. You bear the direct cost of returning the goods. How to return them is set out in the return instructions you will receive from us and on the Returns and Complaints page: after you notify us of the return, we will email you a return code, with which you send the parcel at a Packeta point. For the use of our return code we charge a fee of 22 zł, which we will deduct from the refund amount.
(5) We will refund all payments you have made for the returned goods without undue delay, no later than 14 days from the day on which we receive your statement of withdrawal from the contract (art. 32 of the Act). If you withdraw from the entire contract, we will also refund the delivery cost up to the amount of the cheapest ordinary delivery method offered by us, but not the additional costs resulting from your choice of a more expensive delivery method. We will make the refund using the same payment method as was used for the purchase, unless you expressly agree to a different method of refund that does not involve any costs for you. We may withhold the refund until we have received the goods back or until you provide proof that you have sent them back, whichever occurs first.
(6) You may inspect the goods in the way in which this can be done in a physical shop, in order to assess their nature, characteristics and fit. You are liable for any diminished value of the goods resulting from handling them in a way that goes beyond what is necessary to establish their nature, characteristics and functioning (art. 35 of the Consumer Rights Act); we may make a corresponding deduction from the refund amount. Therefore try on clothes and shoes carefully, on a clean and dry surface, and leave the labels attached.
(7) The right of withdrawal does not apply in the cases set out in art. 38 of the Consumer Rights Act, in particular to non-prefabricated goods that are made to your specification or serve to satisfy your individualised needs, and to goods delivered in a sealed package that cannot be returned after opening for reasons of health protection or hygiene, if the package was opened after delivery.
(8) If a gift was included with the order and you withdraw from the contract, please also return the gift.
9. Complaints
(1) We are liable to you for any lack of conformity of the goods with the contract on the terms set out in the Consumer Rights Act (Chapter 5a, art. 43a–43g). We are liable for any lack of conformity that existed at the time the goods were delivered and becomes apparent within 2 years of that time.
(2) A lack of conformity of the goods with the contract that becomes apparent within 2 years of the delivery of the goods is presumed to have existed at the time of delivery.
(3) The law does not provide for a time limit for notifying us of a lack of conformity of the goods with the contract. However, please report it as soon as possible after you notice it, so that we can handle the complaint more easily.
(4) If the goods do not conform to the contract, you may in the first instance demand that they be repaired or replaced with new goods. If repair or replacement is impossible, would involve excessive costs, or will not be carried out within a reasonable time and without excessive inconvenience to you, you may make a statement reducing the price or cancel the contract. You may not cancel the contract if the lack of conformity of the goods with the contract is insignificant; however, it is presumed to be significant. You may also be entitled to damages on the terms set out in the Civil Code.
(5) Liability does not cover normal wear and tear or damage that has arisen after delivery of the goods, for example because the care instructions given on the label of the goods have not been followed (washing at the wrong temperature, tumble drying, dry cleaning or ironing of items that cannot withstand it) or as a result of an accident.
(6) You can make a complaint by email to info.pl@nordblanc.com, stating the order number, a brief description of the lack of conformity and, if possible, photos. Do not send the goods to us before you have received our instructions. If the complaint is justified, we will bear the cost of sending the goods back to us (shipment via Packeta) and reimburse your reasonable costs incurred in connection with the complaint.
(7) We confirm receipt of the complaint and respond to it within 14 days of receiving it. If we do not respond to the complaint within this period, it is deemed that we have accepted it as justified (art. 7a of the Consumer Rights Act). If we do not accept the complaint in whole or in part, we will explain our reasons in writing and inform you, in writing or on another durable medium (e.g. by email), whether we agree to out-of-court resolution of the dispute under the Act on Out-of-Court Resolution of Consumer Disputes (ustawa o pozasądowym rozwiązywaniu sporów konsumenckich).
10. Personal Data
We process your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR). More information can be found in our privacy policy on the Privacy and Cookie Policy page.
11. Dispute Resolution
If you have concerns, we would first and foremost like to resolve the matter together with you. Please contact us at info.pl@nordblanc.com. If we cannot reach an agreement, you can make use of out-of-court methods of handling complaints and pursuing claims, in particular: you can ask the permanent consumer arbitration court (stały polubowny sąd konsumencki) at the voivodeship inspector of the Trade Inspection (Inspekcja Handlowa) to resolve the dispute, ask the voivodeship inspector of the Trade Inspection to initiate mediation proceedings, or ask the county (city) consumer ombudsman (powiatowy (miejski) rzecznik konsumentów) for free assistance. A list of entities authorised to resolve consumer disputes out of court can be found on the website of the Office of Competition and Consumer Protection (Urząd Ochrony Konkurencji i Konsumentów, UOKiK), www.uokik.gov.pl. In disputes with traders from other EU countries (our company has its registered office in the Netherlands), assistance is provided by the European Consumer Centre Poland (Europejskie Centrum Konsumenckie Polska, www.konsument.gov.pl). You can also bring your claims before a general court (sąd powszechny).
12. Governing Law
Polish law applies to the contract. The choice of Polish law does not deprive you of the protection afforded to you by the mandatory provisions of the law of the country of your habitual residence.
13. Changes to the Terms and Conditions
We may change these Terms and Conditions. The Terms and Conditions in force at the time you place your order apply to your order.
